Small business law Starting and running a business

It is easy to start a business, but it requires thought to do it right.

I help with the setup, and with the contracts that come after.

The questions

The success of your business may depend on asking the right questions first.

“It is smart business to have an attorney on your side.”

James A. Knowlton
  1. Corporation or LLC?

You register the business with the Colorado Secretary of State. An accountant and a lawyer can help you choose.

  2. Who decides what?

An operating agreement or bylaws sets out how the business runs.

  3. How will it be taxed?

That depends on how the business is set up.

  4. What if you step away?

Planning for succession starts with how the business is formed.

  5. Is it in writing?

Contracts, including independent contractor and employment agreements.

  6. How will you get paid?

Collecting what you’re owed, including a mechanic’s lien on a building project.

Nonprofits

If you run a nonprofit, or serve on its board.

I help with nonprofit status and procedures. I have also written about what board members owe the organizations they serve. Read the post
